Subject: Acceptance of Advertising and Kickback Expenses

In response to your request, it has been stated that your company is involved in tourism agency and operator services, providing accommodation, transfer, and tour services to tourists through foreign tourism operators. Occasionally, due to disruptions in services or deficiencies in accommodation, complaints are received from tourists, resulting in refund invoices being issued by foreign operators under titles such as “advertisement” or “kickback”. Even if these invoices are issued in the current fiscal year, they may relate to previous years, and your company only becomes aware of them when the invoice is received.

According to Turkish tax laws and relevant principles, such expenses, even if related to past years, may be considered as deductible business expenses for the period in which they are invoiced, provided they:

  • Are appropriate to the nature of the work and proportional to the scale of business,
  • Are documented with proper supporting documents in accordance with the Tax Procedure Law,
  • Are not caused by the fault of your company, shareholders, managers, or employees.

Thus, such expenses can be deducted when calculating corporate income, subject to compliance with these conditions.

The Eastern Rhodopes’ pristine wilderness offers fantastic chances for mountain tourism, according to Berlin’s “Tagesspiegel” newspaper.

Germans are looking for less expensive vacations.

However, Bulgaria continues to be most popular among Germans as a place to spend their beach vacations. Several tour companies also mentioned this at the significant tourism exhibition that was held in Berlin last month.

Once more, operators focus mostly on Sunny Beach, Golden Sands, and Albena vacations, but more and more frequently they also discuss the fantastic potential for balneotourism in Bulgaria.

However, the public legal media ARD warns that Bulgaria is one of the three summer holiday spots with the largest growth in aircraft ticket prices, up to 28 percent, along with Turkey and Egypt.
Germans are searching for alternative vacation spots for the next summer because the cost of popular tourist destinations like Italy and Spain has skyrocketed.

Domestic trips with one or more than one overnights, increased by 7.3% compared to the same quarter of the previous year and reached to 11 million 411 thousand trips. In this quarter, domestic visitors made 74 million 231 thousand overnights. Average number of overnights was 6.5.

Domestic visitors spent 19 billion 707 million 895 thousand TL

In this quarter, trip expenditures of domestic tourists increased by 83.8% compared to same quarter of previous year and reached to 19 billion 707 million 895 thousand TL. In this quarter, while 91.8% of domestic tourism expenditure was individual with 18 billion 92 million 639 thousand TL, 8.2% of it was package tour expenditures with 1 billion 615 million 256 thousand TL. Average expenditure per trip was 1 727 TL.

When the distribution of expenditure types in total travel expenditures are analyzed in this quarter, it is seen that the expenditure types which have the highest shares were transportation expenditures with 37%, eating and drinking expenditures with 26.8% and accommodation expenditures with 10.4%. According to rate of change of trip expenditures compared to same quarter of the previous year, it was observed that there were increases of 146% in transportation expenditures, 70.5% in eating and drinking expenditures and 15% in accommodation expenditures.

Primary purpose of trip was “visiting relatives” with 63.6%

The secondary purpose of trip was “travel, leisure, vacation” with 26.7% and the third was “health” with 3.4%.

In this quarter, according to number of overnights by type of accommodation, domestic visitors stayed mostly at “house of friend or relative” with 56 million 295 thousand overnights. While “own house” took second place with 6 million 222 thousand overnights, “hotel” took third place with 5 million 951 thousand overnights.

As of 2021, Turkey boasts a total of 519 Blue Flag beaches, as well as 22 marinas, six yachts and ten sustainable tourism boats that have been awarded with the Blue Flag label.

In the global list of 49 countries, Spain takes the lead position with 615 beaches, followed by Greece with 545 beaches.

The Danish nonprofit organization awarded the Blue Flag to 33 more Turkish beaches this year. The majority of the newly designated beaches are located on the Aegean and Mediterranean coasts.

Turkey’s Minister of Environment and Urbanization Murat Kurum stated Turkey is working nonstop to provide a clean habitat for all creatures living around the beaches.

“Today, we are honored to be recognized for all our efforts once again. Our country ranked third in the world in 2021 with 519 Blue Flag beaches,” said Kurum, adding that Turkey aims to ascend the center stage in 2023.

The Blue Flag is a certificate awarded to environmentally safe beaches by the International Environmental Education Foundation (FEE) based in Copenhagen, Denmark.​

Domestic trips with one or more than one overnights, increased by 9.9% compared to the same quarter of the previous year and reached to 12 million 846 thousand trips. In this quarter, domestic visitors made 90 million 840 thousand overnights. Average number of overnights was 7.1.

Annually, domestic trips decreased by 0.4% compared to the previous year and declined to 78 million 202 thousand. In this year, total number of overnights increased by 0.5% compared to the previous year and reached to 637 million 70 thousand. Average number of overnights was 8.1 in 2019.

In this quarter, trip expenditures of domestic tourists increased by 43.7% compared to same quarter of previous year and reached to 7 billion 837 million 481 thousand TL. Domestic tourism expenditures were composed of individual expenditures and package tour expenditures. In this quarter, while 94.0% of domestic tourism expenditure was individual with 7 billion 368 million 927 thousand TL, 6.0% of it was package tour expenditures with 468 million 553 thousand TL. Average expenditure per trip was 610 TL.

In this year, trip expenditures of domestic tourists increased by 21.5% compared to the previous year and reached to 48 billion 910 million 856 thousand TL. While 91.9% of domestic tourism expenditure was individual with 44 billion 945 million 860 thousand TL, 8.1% of it was package tour expenditures with 3 billion 964 million 996 thousand TL. Average expenditure per trip was 625 TL in 2019.

In this quarter, according to rate of change of trip expenditures compared to same quarter of the previous year, the highest increases were in health expenditures with 131.8%, package tour expenditures with 104.5% and other expenditures (sports, entertainment, education, jewellery, gold, silver, carpet, rug etc.) with 53.2% respectively.

In this year, the highest annual increases were in health expenditures with 62.0%, food and beverage with 27.4% and trip expenditures made before trip (clothing, medicine, bags, camera, film etc.) with 26.2% respectively.

The secondary purpose of trip was “travel, leisure, vacation” with 17.8% and the third was “health” with 8.3%.

Annually, while “visiting relatives” was the primary purpose of trip with 63.7%, secondary purpose of trip was “travel, leisure, vacation” with 26.5% and the third was “health” with 4.6%.

In this quarter, according to number of overnights by type of accommodation, domestic visitors stayed mostly at “house of friend or relative” with 62 million 494 thousand overnights. While “own house” took second place with 17 million 790 thousand overnights, “hotel” took third place with 4 million 969 thousand overnights.

Annually, domestic visitors stayed mostly at “house of friend or relative” with 435 million 347 thousand overnights. “Own house” took second place with 115 million 366 thousand overnights and “hotel” took third place with 42 million 713 thousand overnights.

In the fourth quarter which is October, November and December months of 2019 tourism income increased by 20.6% and reached to $ 7 billion 885 million 568 thousand. While 83.3% of this income (excluding GSM roaming and marina service expenditures) was obtained from foreign visitors, 16.7% was obtained from citizens resident abroad.Visitors organise their travel individually or with package tour. While individual expenditures constituted $ 5 billion 804 million 853 thousand of the total tourism income, $ 2 billion 80 million 715 thousand of tourism income was obtained by package tour expenditures.

Tourism income in 2019 increased by 17.0% and reached to $ 34 billion 520 million 332 thousand compared to the previous year. While individual expenditures constituted $ 25 billion 355 million 577 thousand of the total tourism income, $ 9 billion 164 million 755 thousand of tourism income was obtained by package tour expenditures.

In this year, while average expenditure per night for total overnight visitors was $ 68, the average expenditure per night of foreigners was $ 73, average expenditure per night of Turkish citizens resident abroad was $ 50.

Number of departing visitors increased by 12.3%

In this quarter number of departing visitors increased by 12.3% compared to same quarter of previous year and reached to 10 million 841 thousand 340 persons. While 85.9% of visitors was foreign with 9 million 315 thousand 240 persons, 14.1% of them was Turkish citizens resident abroad with 1 million 526 thousand 100 persons.

In this year, number of departing visitors increased by 13.7% compared to the previous year and reached to 51 million 860 thousand 42. While 86.2% of visitors was foreign with 44 million 712 thousand 970 persons, 13.8% of them was Turkish citizens resident abroad with 7 million 147 thousand 72 persons.

In this quarter, foreign visitors visited Turkey mostly for “travel, entertainment, sportive and cultural activities” with 72.4%

The secondary purpose of visit was “visiting relatives and friends” with 13.6% and the third was “shopping” with 4.6%. Turkish citizens resident abroad visited mostly for “visiting relatives and friends” with 65.6%.

Tourism expenditure increased by 6.9%  

Tourism expenditure which is the expenditure of the Turkish citizens resident in Turkey and visited abroad, increased by 6.9% compared to same quarter of previous year and reached to $ 1 billion 23 million 457 thousand. While $ 908 million 897 thousand of total expenditures was individual expenditures, $ 114 million 560 thousand of tourism expenditures was package tour expenditures.

In this year, tourism expenditure decreased by 10.1% compared to previous year and declined to $ 4 billion 403 million 670 thousand. While $ 3 billion 668 million 879 thousand of total expenditures was individual expenditures, $ 734 million 791 thousand of tourism expenditures was package tour expenditures.

Number of Turkish citizens visited abroad increased by 20.8%

In this quarter number of Turkish citizens visited abroad increased by 20.8% compared to same quarter of previous year and reached to 2 million 238 thousand 810. Average expenditure was $ 457 per capita.

In this year, number of Turkish citizens visited abroad increased by 15.1% compared to previous year and reached to 9 million 650 thousand 512. Average expenditure was $ 456 per capita.

According to the news of Hürriyet Daily News, the number of foreigners visiting Turkey jumped 14.3 percent on a yearly basis between January and November, data from the Culture and Tourism Ministry have shown.

Over the past 11 months, a total of 42.9 million foreign holidaymakers entered the country, the ministry said on Dec. 30.

As far as the breakdown by country of origin is concerned, Russians topped the list with 6.9 million visitors or a16 percent share in total foreign tourist arrivals, followed by Germans with 11.3 percent (4.8 million visitors) and Britons with 5.8 percent (2.5 million).

In January-November this year, 2.48 million Bulgarian nationals spent the holiday in Turkey, accounting for some 5.8 percent of total foreign tourists, while Iranians captured the fifth spot with 1.97 million, or 4.6 percent, in total.

Data from the ministry also revealed that the Mediterranean resort city of Antalya was the top tourist draw in the country. It attracted around 14.4 million foreign holidaymakers – 33.7 percent of all visitors – in the first 11 months of the year.

Istanbul was the second most popular destination with foreign tourists. A total of 13.8 million foreign nationals visited the megacity in January-November.

The northwestern province of Edirne, which borders both Bulgaria and Greece, saw the third highest number of foreigners with 4 million, or 9.4 percent, of all visits.

In November alone, the country welcomed 2.2 million foreign visitors, which translated into an 11.4 percent year-on-year rise, data showed.

Last year, some 39.5 million foreigners entered the country, up from 32.4 million in 2017.

The government’s new economic program, released in September, projects $29 billion in tourism revenues for 2019.

According to the estimates in the program, Turkey’s tourism revenues will increase to $34.3 billion next year and further to $40.1 billion in 2021. The government’s revenue target for 2022 is $46.5 billion.

The latest data from the Turkish Statistics Institute (TÜİK) showed that the country’s tourism revenues soared 22 percent on an annual basis in the third quarter of 2019 to stand at $14.03 billion.

In the first nine months of 2019, Turkey’s tourism income totaled over $26.6 billion, up by 16.15 percent from $22.9 billion in the same period last year.

In September this year, Culture and Tourism Minister Mehmet Nuri Ersoy said that Turkey was eyeing 75 million tourists by 2023.

“The average expenditure per capita is targeted to hit $867 in 2023,” he added.

TÜİK reported that in the third quarter of 2019, visitors’ average expenditures were $649 per capita, as foreign visitors spent $623 per capita and Turkish citizens spent $789.
