Our company wants to pay an allowance for food and accommodation expenses of our staff who are sent abroad by duty. Since it is difficult to use a bank account abroad, we want to pay our staff in cash if possible. We kindly request your opinion on the matter.

Allowances are recognized as salaries. They must be paid through the bank. The employees open a currency account in Turkey and the allowances are deposited to those accounts. Employees withdraw the money from the bank and spend it via credit card.

It is not mandatory to pay the salaries via bank if the ship has 9 seamen.

In accordance with Article 8 of the Regulation regarding Payment of Salaries, Premiums, Bonuses and All Kinds of Similar Remunerations via Banks, it is mandatory for employers or employer representatives who employ 10 seamen to pay the salaries through banks.

If a seaman gets arrested, he can not become entitled to severance pay.

In accordance with Subparagraph I of Article 14 of Maritime Law numbered 854 if the contract is canceled by the employer due to reasons other than those stated in this Article, the seaman becomes entitled to severance pay. Getting arrested is among the reasons stated in Subparagraph I of Article 14 of this Law.

One of our employees passed away due to an accident that happened when he was coming to work in our company car. As his dependants, his spouse and 2 children will be made the necessary payments out of our employer’s liability insurance and traffic insurance. We also paid the severance pay and death indemnity of the employee to his dependants.

What I would like to ask is that we want to pay his 2 children until 18 and we want to pay them a certain amount monthly if they continue their education until 25.

It is stated in our employment legislation that the children and dependents of an employee who passed away due to work accident may be provided benefits this way. Is it possible to recognize it as an expense within proportion to the employee’s fault in accordance with Paragraph 3 of Article 40 of Income Tax Law? Or is it a non-tax-deductible expense (KKEG)? Should there be a tax cut during the payment to the dependant’s account?

 

The payments are booked as KKEG.
