DO FOREIGN NATIONAL SHAREHOLDERS AND BOARD MEMBERS NEED TO OBTAIN WORK PERMITS?
In accordance with the Turkish Trade Law numbered 6102:
1- The manager of limited companies who are shareholders,
2- Board member who is a shareholder of a joint-stock company,
3- Limited partnership in which the capital is divided into shares, the active partners who are managers can work with a work permit.

In accordance with the Turkish Trade Law numbered 6102:
1- Board members of joint-stock companies who don’t reside in Turkey,
2- The partners of other companies who are not managers are evaluated in the scope of work permit excemption.

How To Cancel The Work Permit If the Foreigner Doesn’t Start Working?

The cancellation applications for the work permits granted by the Ministry of Labor and Social Security are done via internet.

The petition signed by the employer or the representative of the employer (the date and the reason of dismissal must be stated in the petition) needs to be uploaded in the system as a pdf file for the cancellation to be processed.

Cancellation applications are done by:
1- Entering the e-state system with passwords
2- Choosing Application Monitoring in the Applications menu
3- Application Status – Permit Cancellation Request

The petition entered in the system will not be sent to the Ministry of Labor and Social Security.

How And Where To Pay The Foreigner Work Permit Application Fees?

For the foreigner work permit applications made within the country (time extensions included), it’s obligatory that the legal fee for foreigner work permit and the valuable paper fees are paid seperately for the foreigners whose applications have been confirmed by The Ministry of Labor and Social Security.

***It’s important that the applicants don’t pay until they receive the message from The Ministry of Labor and Social Security stating the amount that needs to be paid.

1- The legal fee and the valuable paper fees can only be paid to the branch of the banks that are stated in the website. The payments that are paid can be viewed on the online system by the Ministry of Labor and Social Security, so when a payment is made (except for rare cases), there is no need to present a receipt to The Ministry of Labor and Social Security.
2- While applying from abroad the work permit fee and the valuable paper fee is paid to the related foreign representative office by the foreigner.

Do The People Working With Foreign Work Permit Get Job Security?

1- WHICH FOREIGNERS WITH WORK PERMIT CAN BENEFIT FROM JOB SECURITY?
In the Labor Law, employers who can benefit from job security are those;
1.1- Employed in a workplace with 30 or more employers,
1.2- With at least six months of seniority,
1.3- Working with an employment contract of indefinite duration.

2- WHAT SHOULD AN EMPLOYER WHO EMPLOYED AN EMPLOYEE WITH A FOREIGNER WORK PERMIT DO TO ANNUL THE CONTRACT RELATED TO JOB SECURITY?
The employer, while annulling the contract of an employer who has job security needs to;
2.1- Acquire employee’s defence,
2.2- Formulate the reason of annulment,
2.3- Declare the annulment in writing,
2.4- Or the annulment shall be void,
2.5- The employee whose contract was annulled can file a lawsuit in labor court, in 1 month starting from the date of the annulment notice, with the claim that no reason was stated in the annulment notice or that the reason stated has no validity.

Can You Apply For A Work Permit Within The Country For A Foreigner With A Tourist Visa in Turkey?

You can’t apply for a work permit domestically for foreigners who are visiting Turkey with a tourist visa.

Except for those given for associate degree and bachelor’s degrees, only foreigners with a residence permit that have a validity of at least six months and haven’t exceeded their time limit can apply domestically.

WHAT IS THE PROCEDURE FOR FOREIGNERS WHO WORK WITHOUT PERMIT AND THEIR EMPLOYERS?
1- There’s an administrative fine for foreigners who work without permit and their employers.
2- The employer who employs the foreigner without work permit or the representative of the employer has to compensate for the foreigner’s, their spouse and children’s accommodation, the necessary expenses for their return and their health expenses when necessary.
3- In the recurrence of employement without work permit, the administrative fine is implemented twice as much again.
4- The foreigners who work without permit are reported to the Ministry of the Interior to be deported.
5- The foreigners who work without permit are investigated regarding their entries to the country, their passports, their visa and residence permits. And if their situation is illegal, their deportation is done by Immigration Authorities.

What Is The Periodic Work Permit Given To Foreigners?

1- WHAT IS THE PERIODIC WORK PERMIT GIVEN TO FOREIGNERS?
In case the foreigner work permit application is approved, the foreigner:
1.1- With the condition of not exceeding the time limit of the contract,
1.2- With the condition of working for a specific company or companies in their main line of business belonging to a real person or a legal entity, or a state institution and organization,
In the first application the foreigner is given work permit that’s valid for at most a year.

2- HOW DO YOU EXTEND THE PERIODIC WORK PERMIT FOR FOREIGNERS?
If the application for work permit is approved then the foreigner can remain with the same employer and gets:
2.1- 2 years at most in the first application to extend the permit.
2.2- upto 3 years in the later applications.

***However, the applications to work for a different employer are considered within the scope of the first paragraph of the first article.

What Should Be Done If The Foreign Worker’s Entry Time To The System Is Missed?

If the Foreigner has applied from abroad but missed the ten day period to enter the system, they need to:
1- Renew the application,
2- Get a new reference number,
3- Make the electronic application in the following 10 days
4- Deliver the documents with wet signature to the Ministry of Labor and Social Security.

However a new application can’t be made from abroad until 30 days pass after the first date of the application.

Can A Foreigner With Work Permit For A Workplace Be Employed In Another Company?

The permits are given to the foreigners to work in a specific residence and when the foreigner resigns from that work the permit loses its validity.

It’s not possible for a foreigner to work in another job with the permission they got to work for a specific employer,
1- The new employer needs to apply for a new work permit from the Ministry of Labor and Social Security, to employ the foreigner in their work place.
2- The new employer’s application for a new work permit gets approved by The Ministry of Labor and Social Security, the previous work permit gets cancelled.
