Work accident, occupational disease, illness and maternity insurance benefits

ARTICLE 16- (Amended: 17/4/2008-5754/10 Art.)
The rights provided by work accident or occupational disease insurance are as follows

a) Provision of daily temporary incapacity allowance to the insured during temporary incapacity for work.

b) Permanent incapacity income to the insured.

c) Income to the beneficiaries of the insured who dies as a result of an occupational accident or occupational disease.

d) Granting marriage allowance to daughters to whom income has been granted.

e) Funeral allowance for the insured who dies as a result of work accident or occupational disease.

Daily temporary incapacity allowance is paid to the insured under the sickness and maternity insurance for the period of incapacity for work due to illness or maternity.

For the insured woman from the maternity insurance or the insured man due to the birth of his non-insured wife, subparagraphs (a) and (b) of the first paragraph of Article 4 of this Law
Among the insured within the scope of the Law, the woman who receives income or pension due to her own work or the non-insured spouse of the man who receives income or pension is given breastfeeding allowance for each child, provided that the child survives, at the tariff valid on the date of birth and determined by the Board of Directors of the Institution and approved by the Minister.

In order for a breastfeeding allowance to be given to an insured woman or an insured man due to the birth of his non-insured wife, the following conditions must be met

a) For those covered by subparagraph (a) of the first paragraph of Article 4 of the Law, at least 120 days of short-term insurance premium must have been reported within one year before the birth,

b) For those within the scope of subparagraph (b), at least 120 days of short-term insurance premiums must have been paid within one year before the birth and all kinds of debts related to premiums and premiums, including general health insurance premiums, must have been paid.

If the insured woman or the insured man whose spouse will benefit from the maternity insurance rights is born within three hundred days starting from this date, the insured woman or the insured man whose spouse will benefit from maternity insurance rights shall benefit from the breastfeeding allowance, provided that at least 120 days of premium payments have been made in the fifteen months prior to the date of birth.
