Will the attendance fees paid to board members of joint stock companies be subject to SSI premium?
According to the SGK legislation, whether or not the attendance fee payments are subject to insurance premiums depends on the insured status of the individuals. If the individuals work under a contract of service in accordance with Article 4-1/a of Law No. 5510, i.e., if they are not also shareholders in the company, these payments are subject to insurance premiums. However, if these individuals are shareholders within the scope of Article 4-1/b, i.e., insurance premiums will not be deducted from the attendance fee payments.
If the members of the board of directors of joint-stock companies work under a contract of service without being a partner, according to Article 4-1/a, the attendance fee payments are subject to insurance premiums. However, for the members of the board of directors who are Bağ-Kur insured within the scope of Article 4-1/b, there is no need to deduct premiums from these payments.
